Warranty Policy - New Equipment

Capstone Industries prides itself on its engineering, design, manufacture and Installation of its range of products. Built for Australian
conditions and to Australian standards and legislative requirements.

Warranty
Capstone Industries warrants that its Products will remain free of defects in workmanship and materials for the period set forth in the
table below and in conjunction with the conditions below.
This warranty represents the entire agreement between Capstone Industries and the owner of the Product and is non-transferable.
This Warranty is in addition to any statutory rights applicable in your State or Territory.

Warranty Period

Warranty Commencement Date:
1. The commencement of the Capstone Industries New Equipment Warranty commences on the day the product was
delivered and installed by Capstone Industries or a Capstone Industries authorised installer.
2. The shipping date the Product was dispatched to the customer (or his or her agent).

Conditions
This Warranty remains valid provided the Product is or was:
• Installed and commissioned in accordance with the Manufacturer’s installation manual.
• Used as intended in the Manufacturer’s literature.
• Maintained at regular intervals in accordance with Manufacturer recommendations.
• Free of any modifications or alterations (which includes tampering with security seals).
• Not operated once a defect is or was known.
• Made available for repair during Capstone Industries’ normal Business Hours.

Warranty cover EXCLUSIONS:
Warranty cover will not be provided for Product failures caused by the following:
• Damage resulting from incorrect installation carried out by third parties.
• Fair wear and tear
• Damage to other equipment
• Damaged caused by misuse or abuse, including operation outside the design limitations of the equipment, such as
exceeding load capacities and cycles.
• Damage caused by short term exposure to water (causing component failure)
• Damage caused by prolonged exposure to water (causing corrosion and structural failure).
• Damage caused by continued use of the Product whilst operational issues were known.
• Claims where the Product has been incorrectly maintained or repaired.
• Transportation costs to and from the Manufacturer.
• Any subsequent costs associated with the Product being out of order.

Extended Warranty:
Capstone Industries is pleased to offer customers the option of an Extended Warranty for further piece of mind following the
purchase of Capstone Industries Products.
To be eligible for extended Warranty cover the following conditions be met;
• An active Preventative Maintenance Program with Capstone Industries must be in place during the duration of the
Warranty and Extended Warranty period.
• All scheduled Preventative Maintenance must be completed in line with the maintenance program.
• Any damaged reported as requiring rectification during the maintenance must be carried out.

Extended Warranty cover EXCLUSIONS:
• Failure to complete all maintenance in accordance with the Preventative Maintenance Program of the new Product
during the Warranty and Extended Warranty period will render the extended Warranty as void.
• All warranty exclusions will exist with reference to the Extended Warranty period

Limitation of Liability
• Capstone Industries’ liability is limited to the repair of the Product and/or payment of the cost of replacing the
Product with an equivalent one at the discretion of Capstone Industries Pty Ltd.
• Capstone Industries will not be held liable for any indirect or consequential loss or for punitive or exemplary
damages or for any loss of profit, loss of revenue, or loss of opportunity.
• No other guarantees or warranties shall be implied and Capstone Industries Pty Ltd will assume no additional
responsibilities whether expressed or implied by any of its agents or representatives.
